After a final inspection from the Building Safety Division, a new building or space cannot be occupied until a Certificate of Occupancy is issued. Once issued, property owners have an obligation to maintain their buildings and structures in accordance with city-adopted codes. 

Certificate of Occupancy 

A Certificate of Occupancy (CO) is a statement issued by the city verifying that a newly constructed building complies with city codes and may be occupied.  

  • After all inspections have been finalized, including by outside agencies, COs may be requested by via eTRAKiT. Learn more about the CO/TCO process in eTRAKiT. Ensure the required documentations listed herein is attached to your application. 
  • For residential projects, please include the following documents with your request: 
    • Improvement Location Certificate 
    • Energy Compliance Certificate 
    • Grading Certificate 
    • Inspections Certification Report (stamped, signed, and dated) prepared by a Colorado licensed professional engineer for projects related to the foundation, footing, perimeter drain, void and water barrier. 
    • UFER Certification
  • A Temporary Certificate of Occupancy (TCO), with a limited timeframe, is available before completion of the entire work covered by the permit provided such the areas or portions of the building can be occupied safely. Use eTRAKiT to apply for a TCO. 
  • A Certificate of Completion without occupancy is also available to certify the construction of the building has been completed in accordance with the building code. 

Maintenance 

  • After occupancy occurs, your building or structure is required to meet the minimum maintenance standards of the Commerce City Building Code (C3BC). Referenced therein are the following codes with city-centric amendments:
    • 2021 International Property Maintenance Code (IPMC) | Amendments
    • 2021 International Fire Code (IFC) | Amendments
  • The city's Code Enforcement staff enforce the IPMC for residential and commercial buildings.
  • The South Adams County Fire Department enforces the IFC for commercial buildings and commercial occupancies.
