In order to be good neighbors during the construction phase of a project, contractors and those engaged in DIY should know the regulations, as listed below that will affect the process. 

Noise

  • Unreasonable noise is addressed in Section 6-2011 of the city's Municipal Code.
  • Noise emanating from construction-related activities and equipment is permitted between the hours of 7 a.m. and 8 p.m. 

Job Site Environment

  • Performance standards for a construction site are addressed in Section 21-5120 of the city's Land Use Code.
  • Vibrations shall not be perceptible by the average person.
  • Air pollution shall not exceed federal and state standards.
  • Dust generated by construction shall not per detectable by a reasonable person. Dirt and debris may not be placed in streets, alleys, sidewalks, or city dumpsters.
  • Hazardous materials shall be stored in accordance with the Commerce City Fire Code.
  • Storage or transportation of construction materials or corresponding waste shall not generate dust or discharge liquid into the ground, 
  • Measures to mitigate the above must be effective on the site at all times. 

Building Permit Onsite

The Commerce City Building Code requires building permits to be on the job site for the duration of the permit. 

Adjacent Properties, Workers and the Public

  • Safeguards of construction are regulated by Chapter 33 of the International Building Code as adopted by Commerce City.
  • Sanitary restroom facilities shall be provided during the duration of the project.
  • Storage of materials on site shall not endanger workers, the public or adjoining properties.
  • Contractors shall control water runoff and erosion.
  • Adjacent properties and structures must be protected from damage.
  • If a project involves demolition or excavation, the contractor must notify the owners of adjacent properties before obtaining demolition/excavation operations.
  • Any open excavation site (including digging out a basement) or other hazardous job site must be surrounded by a 6-foot fence to prevent unauthorized access. 

Impact on Streets or Alleys

  • Section 10-1302 of the city's Municipal Code addresses the impact of construction on rights-of-way including streets and alleys.   
  • Obtain a right-of-way permit from the Department of Public Works before placing a container or dumpster in the street or otherwise blocking a street or alley.
  • Pavement, trees, and other property in the right-of-way shall be protected, and, if damaged, shall be cleaned and restored. 

Preventing Theft

  • Consider drafting a no-trespassing agreement for your site so police can enforce trespassing laws.
  • Install lighting, alarm or surveillance camera systems.
  • Lock and secure tools and other valuables.
  • Mark your tools, equipment and other valuable property and record VIN or serial numbers. 

Addressing Lead-Based Paint and Asbestos

Lead based paint, its removal and the lead dust that may be created during construction could be a hazard. Learn more
